DECLARATIONS ARTICLE IX - ARCHITECTURAL CONTROL

Unless plans and specifications have been submitted to and approved in writing by the Committee,

  1. No structure or other improvement of any kind or description, the placement of which upon any Lot or Common Land may affect the appearance of such Lot, including but not limited to any building, fence, swimming pool, garage, porch, or shed to be permitted to remain on any Lot
  2. Submissions to the Committee should include a site plan of the Lot showing the nature, materials and location with respect to the particular lot 


The Committee has the right to disapprove any plans and specifications submitted because of any of the following:

  1. failure of such plans or specifications to comply with any of the Covenants and Restrictions;
  2. failure to include information in such plans and specifications as may have reasonably requested;
  3. objection to the exterior design, proportions, appearance or materials of any proposed structure;
  4. incompatibility of any proposed Structure or use with existing structures or uses upon other Lots in the vicinity;
  5. objections to the location of any proposed structure upon any Lot or reference to other Lots in the vicinity;
  6. objection to the grading plan for any Lot;
  7. objection to parking areas proposed for any Lot on the grounds of incompatibility or insufficiency of the size of parking areas related to the Lot
  8. any other matter which, in the judgement of the Committee, would render the proposed Structure inharmonious with the general plan of improvement of The Properties or with Structures or uses located upon other Lots in the vicinity.


In any case where Committee disapproves any plans and specification submitted, or approves under specified conditions, a statement of the ground upon which such action was based will be provided. 


If the application is in violation of this Article IX, any Structure so altered, built or placed on any Lot in violation shall be removed or realtered, and any such use shall be terminated. If sixty (60) days after the notice of such violation, the Committee has the right to enter upon such Lot and take necessary steps to extinguish such violation. 

Each Owner of a Lot shall maintain the grounds

Each Owner of a Lot shall maintain the grounds there of in a neat and attractive manner and upon the failure of the Owner to do so, the Committee may enter upon the Lot as often as the Committee shall deem necessary and cut down the weeds, grass and other vegetation thereon and remove dead trees and shrubbery. 

THE BOARD MAY ADVANCE FUNDS TO COVER EXPENSES

The Board of Directors may advance funds of the Association to the Committee to cover the expenses of the operations of the Committee.

tHE OWNER MUST REIMBURSE THE COMMITTEE FOR THE COST

The Owner of any Lot upon which the Committee performs these services or supplies materials shall reimburse the Committee for the cost.

The decision of the Committee OF the exterior

The decision of the Committee as to whether the exterior of any structure located on any Lot has been maintained in good repair and appearance and whether the grounds of any Lot have been maintained in a neat and attractive manner shall be final and conclusive.
